Deer Valley Snow Park Village Redevelopment

On December 14, 2023, the City Council voted to approve Ordinance 2023-56 vacating portions of the Deer Valley Drive right-of-way at the Snow Park base, and to form a public-private partnership with Deer Valley Resort. The framework of the partnership is articulated in a Letter of Intent. The Utah Code defines road vacation as a legislative act and authorizes it in the Municipal Land Use, Development, and Management Act (MLUDMA). MLUDMA is the state law governing municipal land use. The vacation must be done by ordinance. MLUDMA requires “good cause” and no “material injury” in Utah Code Section 10-9a-609.5(4):

(4) The legislative body may adopt an ordinance granting a petition to vacate some or all of a public street or municipal utility easement if the legislative body finds that:

(a) good cause exists for the vacation; and

(b) neither the public interest nor any person will be materially injured by the vacation.

Good Cause is defined in Park City Land Management Code (LMC) Section 15-15-1 as: 

Providing positive benefits and mitigating negative impacts, determined on a case by case basis to include such things as: providing public amenities and benefits, resolving existing issues and non-conformities, addressing issues related to density, promoting excellent and sustainable design, utilizing best planning and design practices, preserving the character of the neighborhood and of Park City and furthering the health, safety, and welfare of the Park City community.

Material Injury, under the case law, requires a showing that the individual has suffered special damages which are different in kind from damage to the public generally, and it usually requires a showing that a property’s access has been terminated. An individual alleging that accessing their property is less convenient has not shown material injury or harm that is different from the public generally. 

If the Council grants Deer Valley Development Company Inc.’s Vacation Petition, the Planning Commission will resume its review of the Master Planned Development and Conditional Use Permit applications. If the Council denies Deer Valley Development Company Inc.’s Vacation Petition, the Applicant must eliminate the use of public right-of-way from the proposed development or appeal to District Court.

Deer Valley Resort Snow Park Applications

On August 24, 2021 Deer Valley Resort submitted the following applications to the Planning Department:

  • Conditional Use Permit application for Phase 1 of the redevelopment of the Snow Park Base Area and surface parking lots. Proposed Phase 1 includes the Overall Site Plan, a new 4-story parking structure partially built into the grade, and a new Transit and Mobility Hub. In addition to the parking structure, proposed Phase 1 includes redirecting skier traffic to Deer Valley Drive East and prioritizing transit on Deer Valley Drive West.

  1. 1977 Special Exception Permit, amended multiple times;
  2. Deer Valley Twelfth Amended and Restated Large Scale MPD Permit (MPD/DA) dated November 30, 2016. Currently in place;
  3. Park City’s Land Management Code (LMC) Chapter 15;
  4. Park City’s current Affordable Housing Resolution 25-2020;
  5. Park City’s 2014 General Plan including the Lower Deer Valley Neighborhood;
  6. Park City’s Adopted Transportation Plans, as prioritized by the Park City Vision 2020 and the five Strategic Pillars including Transportation Innovation.
